{"id":2207,"date":"2017-01-30T17:34:25","date_gmt":"2017-01-30T17:34:25","guid":{"rendered":"http:\/\/www.nelsonboydlaw.com\/blog\/?p=2207"},"modified":"2021-09-02T21:23:32","modified_gmt":"2021-09-02T21:23:32","slug":"equal-pay-care","status":"publish","type":"post","link":"https:\/\/www.nelsonboydlaw.com\/blog\/articles\/equal-pay-care\/","title":{"rendered":"What is Equal Pay and Why Should You Care?"},"content":{"rendered":"<p><strong>What is Equal Pay and Why Should You Care?<\/strong><\/p>\n<p>By <a href=\"http:\/\/andrusanderson.com\/profile\/lori-e-andrus\/\">Lori Andrus, Esq.<\/a><\/p>\n<p>Although we make up 46.8 percent of the workforce,<a href=\"#_edn1\" name=\"_ednref1\">[i]<\/a><strong> today women still only earn 80 cents on the dollar when compared to men.<\/strong><a href=\"#_edn2\" name=\"_ednref2\">[ii]<\/a><sup>,<a href=\"#_edn3\" name=\"_ednref3\">[iii]<\/a><\/sup> And that difference really adds up over time. As Lilly Ledbetter\u2014who was shortchanged for 19 years by her employer, Goodyear Tire &amp; Rubber Company\u2014said so eloquently in 2012: \u201c[w]hen we lose 23 cents every hour, every day, every paycheck, every job, over our entire lives, what we lose can&#8217;t just be measured in dollars.\u201d<\/p>\n<p><strong>Equal pay is not just a women\u2019s issue; it\u2019s an economic issue.<\/strong> Women make up nearly two-thirds of minimum wage earners.<a href=\"#_edn4\" name=\"_ednref4\">[iv]<\/a> Women are the primary or sole breadwinner in 40% of households with children under age eighteen.<a href=\"#_edn5\" name=\"_ednref5\">[v]<\/a> In California alone, if women were paid fairly, an additional $33 <strong><em>billion<\/em><\/strong> dollars would flow into the state\u2019s economy, <em>per year<\/em>.<a href=\"#_edn6\" name=\"_ednref6\">[vi]<\/a> Paying women what they\u2019re owed would cut women\u2019s poverty rate in half overnight.<a href=\"#_edn7\" name=\"_ednref7\">[vii]<\/a> <strong>All of us, not just women, will benefit when pay equity is won.\u00a0\u00a0 <\/strong><\/p>\n<p>Perhaps you\u2019ve heard that the gender gap only exists because women \u201cchoose\u201d lower-paying fields, or because women \u201copt-out\u201d of the workforce to raise children. But a 2016 Cornell University study shows that women\u2019s work is simply undervalued.<a href=\"#_edn8\" name=\"_ednref8\">[viii]<\/a> As women take over male dominated jobs, the pay drops for everyone. Apparently, \u201cif a woman can do the job, then it must be worth less to society.\u201d<\/p>\n<p>The good news is that <strong>equal pay is required by law. <\/strong><u>If you are being paid less than a male worker doing the same or substantially similar work, <strong>you should consult with a plaintiff\u2019s lawyer<\/strong><\/u> (whose services are no charge upfront and who is compensated only if and when your case is favorably resolved).<\/p>\n<p>It doesn\u2019t matter whether you believe your employer is intentionally discriminating against you because of your gender: <strong>you may have a legal claim even if the difference in pay is unintentional.\u00a0 <\/strong><\/p>\n<p>Specifically, the federal Equal Pay Act requires employers to pay men and women doing the same work equally. Many states offer even greater protections for workers.<\/p>\n<p>These laws are vital to the economic security of women workers. When women workers band together in class actions, a lawsuit can be a very powerful tool to bring about positive change in the workforce (and in society).<\/p>\n<p>Every jurisdiction requires that legal actions be commenced within certain time limits, or the right to sue is lost.
